These Terms of Service ("Terms") govern your use of the WearWho website located at wearwho.com ("Site") and any purchases you make through it. By accessing the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
WearWho is operated by WearWho Inc., a Delaware corporation ("WearWho," "we," "us," or "our").

## 1. Using Our Site
You must be at least 18 years old to place an order on wearwho.com. If you are under 18, you may only use the Site with the involvement of a parent or guardian.
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site or its related systems
- Submit false or misleading information when placing an order
- Reproduce, duplicate, copy, sell, or exploit any portion of the Site without our express written permission
- Use automated tools (bots, scrapers, crawlers) to access or collect data from the Site
We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion if we believe these Terms are being violated.

## 2. Products & Orders
**Made on demand.** Every WearWho product is manufactured on demand at the time of purchase. Product availability, designs, and themes may change between seasons without notice.
**Order acceptance.** Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. If we decline your order after payment has been collected, we will issue a full refund.
**Pricing.** All prices are listed in US dollars and are subject to change without notice. The price at the time of checkout is the price you pay. Applicable taxes will be calculated at checkout based on your shipping address.
**Order changes.** Because production begins quickly after an order is placed, we cannot guarantee that changes or cancellations can be accommodated once an order is confirmed. Contact us immediately at support@wearwho.com if you need to modify an order — we'll do our best.
**Customized and personalized items.** Orders that include custom names, dates, photos, or text are final sale once production begins. You are responsible for reviewing and confirming all customization details before approving your order. If we produce an item incorrectly based on the information you provided, we cannot offer a refund, but we will correct any error on our end at no cost to you.

## 3. Pricing, Payment & Taxes
We accept major credit cards, debit cards, PayPal, Apple Pay, and Shop Pay. Payment is processed at the time of order placement.
You represent that you are authorized to use the payment method you provide. If payment is declined or reversed for any reason, your order will be cancelled.
Sales tax is collected where required by law based on your shipping address. International orders may be subject to customs duties and import taxes upon delivery — these are the buyer's responsibility and are not included in our pricing.

## 4. Shipping & Delivery
All orders are produced in Shangrao, China and shipped directly to your delivery address via DHL, FedEx, or UPS. Standard delivery to the US takes 7–10 business days from the date of order.
We are not responsible for delays caused by customs clearance, carrier disruptions, or events outside our control. Once a package has been handed to the carrier, tracking information will be provided via email.
Risk of loss and title for items purchased pass to you upon delivery to the carrier.

## 5. Returns, Refunds & Exchanges
Because our products are made on demand, we do not accept returns or exchanges for change of mind or incorrect size selection.
We will replace or refund items that arrive defective, damaged, or incorrect. Claims must be submitted within 14 days of delivery with supporting photos.

## 6. Intellectual Property
All content on this Site — including but not limited to designs, graphics, logos, text, photographs, and software — is owned by WearWho Inc. or licensed to us, and is protected by US and international intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.
**User-submitted content.** If you submit photos, designs, or other content to us (for example, for a custom order or UGC campaign), you grant WearWho a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for the purposes of fulfilling your order and promoting our products. You represent that you own or have the rights to any content you submit, and that it does not infringe any third party's intellectual property rights.
**Reporting infringement.** If you believe content on our Site infringes your intellectual property rights, please contact us at support@wearwho.com with details of the alleged infringement.

## 7. User-Generated Content & Community
WearWho operates social community features including the Crew System membership program and UGC campaigns using hashtags such as #WearWhoCrew. By participating, you agree that:
- Content you post publicly using our branded hashtags may be featured on our Site or social channels with attribution
- You will not post content that is offensive, defamatory, discriminatory, or in violation of any third party's rights
- We reserve the right to remove any user content at our discretion

## 8. Crew System Membership
Participation in the WearWho Crew System loyalty program is subject to the Crew System Terms available at wearwho.com/crew-terms. Points and rewards have no cash value and cannot be transferred. We reserve the right to modify or discontinue the Crew System at any time with reasonable notice.

## 9. Disclaimer of Warranties
The Site and all products and services offered through it are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

## 10. Limitation of Liability
To the fullest extent permitted by law, WearWho Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products, even if we have been advised of the possibility of such damages.

Any dispute arising out of or relating to these Terms or your use of the Site that cannot be resolved informally shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, conducted in English. You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
